Cartoon by James Gillray satirizing Sir Francis Buller, 1782: "Judge Thumb; or, Patent Sticks for Family Correction: Warranted Lawful!". A modern folk etymology [14] relates the phrase to domestic violence via an alleged rule under English common law which permitted wife-beating provided that the implement used was a rod or stick no thicker than a man's thumb. Gigerenzer & Gaissmaier (2011) state that sub-sets of strategy include heuristics, regression analysis, and Bayesian inference. [14]A heuristic is a strategy that ignores part of the information, with the goal of making decisions more quickly, frugally, and/or accurately than more complex methods (Gigerenzer and Gaissmaier [2011], p. 454; see also Todd et al. Berths are either general or specific to the types of vessel that use them. The size of the berths varies from 5–10 m (16–33 ft) for a small boat in a marina to over 400 m (1,300 ft) for the largest tankers. The rule of thumb is that the length of a berth should be roughly 10% longer than the longest vessel to be moored at the berth. [why?]
"Rule of Thumb and the Folklaw of the Husband's Stick". Journal of Legal Education 44 (3): 341–365. it's available on JSTOR. It's free. Sonicyouth is misquoting it greatly. None of what he's written is an accurate summation. It's a fringe view that "Rule of thumb" has a legal history of wife beating and his use of Kelly is egregiously misquoting.
