The Fair Use Project is part of the Stanford Center for Internet and Society at Stanford Law School. Founded in 2006, it offers legal assistance to "clarify, and extend, the boundaries of "fair use" in order to enhance creative freedom." [1] It is headed by Tony Falzone, lecturer at Stanford Law. [2]
This is a request for comment (RFC) on the use of fair use images in lists. This RFC aims to gather community opinion on the use in lists of images claimed to be fair use , and to generate a consensus about whether current usage is acceptable, and if not, how affected lists ought to change in order for the use of images to be acceptable.
Develop new fair use image copyright tags. Many of the current image copyright tags for "fair use" are short blanket statements which encourage legally incorrect thinking about fair use. Some suggested general improvements: The tags should be more detailed, stating the rationale for fair use and implicitly defining what is and what is not fair use.

This page is a description of stock "fair use" rationales for use with "fair use" copyright tags on the English-language Wikipedia. If the "fair use" tags are correctly applied to images, these descriptions should be accurate in describing the claims Wikipedia would make as to the "fair use" status of said images were they taken to court.

You may want to familiarize yourself with the other tags on the page as well, because a few images are tagged as "fair use" when they are really free. Unused "fair use" images can be speedy deleted if they have been on the site for seven days or more.
The last two favor fair use in the extreme with the second counting against all fair use of tv episodes and the first is apparently of question. Claim #1 to be the most important if you wish but all 4 are considered and half of the four should out weigh the first two by the extreme favoring of fair use.
