Discussions among the city, state, and Valley Railway continued until 1908. That year, an appraiser once more found in favor of the railway. Frustrated, the state attorney general filed a motion in state district court in early March 1908 demanding title to the canal bed. [48] In October of that year, the railway filed a demurrer in the case. [49]
