The 12th New York Volunteer Infantry was organized at Elmira, New York and mustered in May 8, 1861 for two years' state service under the command of Colonel Ezra L. Walrath. On May 13, 1861 the regiment was re-mustered for three months' federal service and again re-mustered on August 2, 1861 for two years' state service.
Following the success of the model 1870, the Governor of New York ordered 15,000 Remington rolling block rifles and bayonets for his state's militia. These model 1871 rifles were very similar to the model 1870 rifles, but differed in some details. Field experience with the model 1870 showed that the mechanism jammed too easily in dusty conditions.
The Van Schoonoven's Regiment of Militia, also known as the 12th Albany County Militia Regiment, was called up in July 1777 at Halfmoon, New York, to reinforce Gen. Horatio Gates's Continental Army during the Saratoga Campaign. The regiment served in Brigadier General Abraham Ten Broeck's brigade.

The 265th New York State Militia was a small unit of the New York line and could trace its lineage to the War of 1812.The new regiment was given the designation, 14th regiment, which is one of the oldest military organizations in the United States because of its direct lineage through various separate companies, to the militia companies of the Dutch burghers of New Amsterdam.
