Balfour v Balfour [1919] 2 KB 571 is a leading English contract law case. It held that there is a rebuttable presumption against an intention to create a legally enforceable agreement when the agreement is domestic in nature.
In 1919, Lord Atkin held in Balfour v Balfour [5] (where a husband promised his wife to pay maintenance while he worked in Ceylon) that there was no "intention to be legally bound", even though the wife was relying upon the payments. The judge stated that as a general rule, agreements between spouses would not be legally enforceable:

In Balfour v Balfour [7] [1919] 2 KB 571, Atkin LJ said, Agreement between the parties must such that they have an intention to enter into contract having consensus ad idem i.e. meeting of mind should be there and it should be in the same sense while entering into contract.
