The Natives Land Act, 1913 (subsequently renamed Bantu Land Act, 1913 and Black Land Act, 1913; Act No. 27 of 1913) was an Act of the Parliament of South Africa that was aimed at regulating the acquisition of land. It largely prohibited the sale of land from whites to blacks and vice-versa.
The Land Act 1913 reserved 92% of South Africa's territory for whites, and only 8% for blacks. This was enlarged to around 13.6% by the Native Trust and Land Act, 1936 , although the population of the country that was black stood around 61%.
The South African law of sale is an area of the legal system in that country that describes rules applicable to a contract of sale (or, to be more specific, purchase and sale, or emptio venditio), generally described as a contract whereby one person agrees to deliver to another the free possession of a thing in return for a price in money.
Roman-Dutch law adopted this position, and it is still in force in South Africa. The modern contract of lease is therefore the Roman locatio conductio rei, the rental or hire of a thing. Contrary to Roman law, however, is that in South Africa prevails the Roman-Dutch doctrine of huur gaat voor koop (“lease trumps sale”).
This ordinance stipulated that the reserve land, which the black population in the Natives Land Act, 1913 had been allocated to 7.13% (9,709,586 acres (3,929,330 ha)) of the total land, be enlarged to approximately 13.6% of the total area of then South Africa. This value was not reached and remained so unfulfilled until the 1980s.
The minister of land reform and rural development is a minister in the Cabinet of South Africa.The office was established as the minister of rural development and land reform in May 2009, though it was subsequently merged with the agriculture portfolio under the minister of agriculture, land reform and rural development from 2019 to 2024.
