The Governor's Council, also known as the Privy Council and Council of State, was the upper house of the legislature of the Colony of Virginia (the House of Burgesses being the other house). It also served as an advisory body to the royal governor and as the highest judicial body in the colony.
Prior to that a Council of State existed; it chose from among its members a president who would be "lieutenant-governor" and would act as governor when there was a vacancy in that office. [ 1 ] [ 10 ] The governor and the lieutenant governor are elected at the same time but not on the same ticket.

Shortly thereafter Wormeley was appointed a member of the Virginia Governor's Council, [4] and as such supported the unpopular governor John Harvey. Edward Digges (14 February 1620 – 15 March 1674/75) was an English barrister and colonist who became a premium tobacco planter and official in the Virginia colony.The son of the English politician Dudley Digges represented the colony before the Virginia Company of London and the royal government, as well as served for two decades on the colony's Council of State.
Upon the death of Thomas Lee on November 14, 1750, Burwell became the senior member of the council. Because the governor and lieutenant governor were both out of Virginia at the time, he served as president, effectively making him acting Governor of Virginia, until the arrival of Lieutenant Governor Robert Dinwiddie on November 21, 1751.
