United States v. Warshak, 631 F.3d 266 (6th Cir. 2010) is a criminal case decided by the United States Court of Appeals for the Sixth Circuit holding that government agents violated the defendant's Fourth Amendment rights by compelling his Internet service provider (ISP) to turn over his emails without first obtaining a search warrant based on probable cause.
Generally, such efforts are not effective in protecting email privacy. For example, in Shoars vs. Epson America, Inc. case (Cal. Sup. Ct. filed July 30, 1990) a California superior court refused to find employee email privacy protection in California's criminal code.
The U.S. Court of Appeals for the Sixth Circuit held in 2010 that users did have a reasonable expectation of privacy in the contents of their e-mail in United States v. Warshak, although no other court of appeals has followed suit. [20]
