Arbitration, in the context of the law of the United States, is a form of alternative dispute resolution.Specifically, arbitration is an alternative to litigation through which the parties to a dispute agree to submit their respective evidence and legal arguments to a third party (i.e., the arbitrator) for resolution.
The parties and/or the mediator are free to withdraw at any time. The contents of mediation are confidential, and cannot be used for other purposes, including arbitration. However, bad faith conduct is not excused or protected by the mediation privilege, and deliberate bad-faith activities will not be protected.
